SANTO DOMINGO, R.D. Mayo 6, 2021.- El diputado por la provincia de Santiago, Leonardo Alfonso Aguilera, durante su intervención ante el hemiciclo, manifestó que urge la aprobación en primera lectura del Proyecto de Ley Especial Transitoria que busca la terminación de las obras inconclusas del Estado.
Aguilera, quien es un abanderado del proyecto, explicó que con esta ley se reactivaría la economía y se generarían un sin número de empleos, momentos en que el país atraviesa por una crisis debido a la incidencia de la pandemia del Covid-19.
“Todos sabemos que el sector construcción es uno de los pilares económicos de una nación, esta ley va a impactar 741 obras e igual número de contratistas que podrán volver trabajar, además de miles de personas que podrán impactar de manera indirecta con empleos”, añadió el honorable congresista.
El legislador del Partido Revolucionario Moderno (PRM) indicó que la mayoría de las obras están varadas por el nudo legal que mantiene la Ley de Compras y Contrataciones 340-06, que indica que los contratistas no se puede exceder más allá de un 25% del presupuesto inicial para su terminación.
Aguilera, diputado por la circunscripción número 1 de Santiago, aclaró que muchas de las obras inconclusas que persisten hoy en el gobierno son consecuencias del presupuesto base que se les asignó a los contratistas, sin tomar en cuenta un estudio de suelo que en muchas ocasiones produce un aumento de los costos.
“Del estudio de suelo se deriva la volumetría de corte y bote, el diseño estructural y cuando se modifica una viga, una columna, eso incluye más empañete, más hormigón, más pintura, en fin un aumento prácticamente en todas las partidas,entonces cuando inician el proyecto van con un déficit negativo hasta el final”, precisó.
Señala que muchos de los contratistas cuando llegan a realizar sus obras se enfrentan a una situación difícil, al tiempo que insistió en que se debe aprobar el proyecto de Ley Especial Transitoria para garantizar la culminación.
“Con esta ley se marcaría un precedente positivo presidente, esto sería la continuidad humana del Estado”, dijo al referirse al presidente de la Cámara de Diputados Alfredo Pacheco.
Aseguró que ahora el Estado está dando la oportunidad a contratistas que ganaron el sorteo y aquellos que están paralizados desde la gestión del pasado gobierno, que vuelvan a retomar sus obras, “sería de suma importancia la aprobación de la misma”.
Recordó que el abandono de las obras pudiera elevar los costos de los materiales y esto generaría pérdidas que se reflejarán en el presupuesto del Estado.
“Todo aquel que ha tenido una obra sabe que los precios unitarios no varían por contrato, no importa que su obra dure 3 o 4 años, y la elevación de los costos de los materiales lo asumen los contratistas, por eso el estado modificaría esos precios”, recalcó.
