NEIBA, Bahoruco, R.D., Enero 28, 2021.- El ex diputado Rafael Méndez aseguró que la ley 28-01, que crea la Zona Especial de Desarrollo Fronterizo, ha sido una legislación natimuerta desde su promulgación hace 20 años, en términos de su cumplimiento por parte de las autoridades competentes, y debido a la escasa voluntad política de los gobiernos de turno.
“Decimos que la Ley 28-01 ha sido una legislación natimuerta, no
porque su vigencia está llegando a su final, sino porque los
beneficios que otorga esa legislación a las empresas instaladas o que
buscan instalarse en la frontera, han sido escaso o nulos, en mayoría
de los casos, por el incumplimiento de los funcionarios que les
corresponde aplicar los beneficios”, subrayó.
El pasado diputado por la Provincia Bahoruco consideró que la nueva
ley debe establecer sanciones para los funcionarios que no cumplan con
los incentivos que contemple, así como plazos para que el consejo de
coordinación conozca las solicitudes de instalación de las empresas
que se les someta a su consideración y aprobación.
“Decimos esto con suficiente conocimiento de causa, ya que hemos sido
testigos de que el consejo de directores y los funcionarios
competentes dejan dormir adrede en sus gavetas los expedientes que se
les somete, para responder así a dictados de órdenes superiores”,
aseguró.
Recuerda que la región fronteriza es el único espacio geográfico que
goza de la mayor seguridad jurídica, avalada en sentencias de las
altas cortes.
La Ley 28-01 es la única legislación que complementa fielmente el
mandato constitucional que llama a poner atención a la zona
fronteriza.
