La necesidad de realizar acciones que requirieran el mínimo contacto y desplazamiento durante la crisis sanitaria del covid-19 impulsó los avances tecnológicos necesarios para la modernización de las operaciones comerciales, como es el caso de la emisión de firmas digitales.
El vicepresidente de la Cámara de Comercio y Producción de Santo Domingo (CCPSD), Antonio Ramos, explicó que desde el 2007 la entidad de la que forma parte se encuentra autorizada para la certificación de firmas electrónicas, pero no ha sido hasta el último año que la demanda de emisiones de certificados para firmas electrónicas se ha duplicado tanto dentro como fuera del país, a la par con la integración de esta modalidad por parte de las instituciones públicas.
El ejecutivo calificó este avance como sorprendente, en un contexto en el que todavía prevalece «la firma con bolígrafo azul», y explicó la importancia de validar las firmas digitales en el territorio nacional para garantizar la presunción de no repudio de la rúbrica.
Explicó que una firma electrónica cualificada por una agencia certificadora es la manera más segura de autenticar que la rúbrica representa al signatario, lo que lo protege ante circunstancias legales, ya que la cualificación es reconocida por el Instituto Dominicano de Telecomunicaciones (Indotel).
«La firma electrónica existe dentro del mundo digital. No es una impresión de ella, pues esta reside dentro del archivo que se firmó, cuyas propiedades te dan información sobre la firma: Quién la firmó, dónde y cuándo. Es un documento que no permite alteraciones, lo que le da fuerza y valor», explicó el economista en la conferencia virtual «Digifirma: Retos de la firma electrónica en República Dominicana», organizada por la Cámara Americana de Comercio (AmchamDR).
A diferencia de una firma simple, que carece de valor legal, o de una firma avanzada, que sí cuenta con valor pero sigue siendo vulnerable, la firma cualificada otorga mayor protección ante las acciones fraudulentas, pues cuenta con la validación de un tercero certificado para ese trabajo.
El Banco Central, la Dirección General de Impuestos Internos (DGII) , el Poder Judicial y la bolsa de valores dominicana son algunas de las instituciones que han reforzado sus estrategias para ofrecer este servicio, lo que Ramos consideró como un avance importante para que más entidades «pierdan el miedo» ante las firmas digitalizadas.
